A producer is any business that:
- manufactures and sells electrical and electronic equipment (EEE) under their own brand
- resells under their own brand equipment produced by others
- imports electrical and electronic equipment (EEE)

Producers will attract a different obligation dependant on whether the EEE produced is intended for use by private households
or intended for users other than private households.
All producers of EEE intended for use by private households and users other than private households MUST have:
- registered with an approved producer compliance scheme before 15 March 2007
- marked all EEE with 'the crossed-out wheeled bin symbol' before April 2007
- marked all EEE with a producer identification mark and a date mark
- declared the amount in tonnes, units and by category, of all EEE intended for use, placed onto the UK market between 1 January 2006 to 31 December 2006
- made their unique producer number available to customers to whom EEE is supplied
- provided information on reuse and treatment of each new type of EEE placed onto the market within one year
- demonstrated that they have complied with their producer obligations in any member state (excluding the UK) into which they supply EEE via distance communication
- maintain records of the above for 4 years
