Producers of EEE intended for users other than private households (e.g. commercial, industrial or professional purposes) are required to finance the cost of the collection, treatment, recovery and environmentally sound disposal of:
- new WEEE (displaying 'the crossed-out wheeled bin symbol') the producer has placed onto the market after the 13 August 2005
and
- historic WEEE (not displaying 'the crossed-out wheeled bin symbol') when the producer is supplying new WEEE intended to replace historic WEEE, is of equivalent type or fulfils the same function
Producers may partake in an agreement with their customers to make alternative commercial arrangements to finance the cost of collection, treatment and environmentally sound disposal of WEEE.
Historic WEEE
Historic WEEE is EEE placed onto the market before the 13 August 2005; therefore, NOT displaying 'the crossed-out wheeled bin symbol'.
Historic WEEE that is not being replaced must be treated, recycled and disposed of in an environmentally sound manner, at the cost of the business end user.
Producers replacing Historic WEEE with new WEEE must offer to take Historic WEEE away for treatment, recycling and environmentally sound disposal. The cost will lie with the producer of the new replacement EEE, providing the Historic WEEE is of equivalent type or fulfils the same function as the new EEE, unless alternative commercial arrangements are in place.
New WEEE
New WEEE is EEE placed onto the market after the 13 August 2005; therefore, DISPLAYING 'the crossed-out wheeled bin symbol'.
New WEEE must be treated, recycled and disposed of in an environmentally sound manner, at the cost of the producer of the new WEEE, unless alternative commercial arrangements are in place.
